    i have had asbestos case with these ga. lawyers for 20yrs. on my husband (died asbestosis)and cancer everywhere. he was 35yrs.old then. they have given some money, and said the rest are in bankrupt. the checks i got did not have a company name except where the law.office had printed. i want to see the original checks they deducted my money from. his secretary told me i was getting to thousand march 1991, promised, i might have gotten 15 in all from different com.? through the yrs.i am in tenn.he is in ga. i just want to know if i have been taken advantage of or how can i find out.

      yes you have…You have know way of knowing how many checks or how much money the companies have paid your lawyers. You will never see all of the checks. They will only show you the checks that they have deducted there 33% from. You have probably been shafted for about 35 to 45 thousand. You need to get another lawyer that you trust. He will have to uncover the case with your other lawyer. This will cost you another 33% but might get you a few thousand dollars. It will be hard to find a lawyer to take on another lawyer!! Sorry, sounds like you should have picked a better attorney!

      You are mistaken, America is awash with lawyers who want to talk about this horrible (but extremely rare) phenomenom, but it is hardly a “real” problem, unless you happen to be unfortunate enough to be a victim yourself. Mesothelioma will indeed kill some people, perhaps as many as 3,000 in 2008, whereas 3,000,000 people will sucumb to a smoking-related death during the same period.

    Ok well a friend of mine is gong through a lawsuit about some asbestos where he formerly worked. It was a paper mill that was around his family and most of his family and friends worked there(The mill closed down like in the early 90s). A lawyer approached him and his family/friends telling them that they had a case. So they went ahead and sued and for over 10 years the case has been in the process. Now the case is supposedly settled. He called the lawyer and the lawyer says its supposed to be millions but he doesn’t know the exact amount. Some people in his family have died from brain damage, cancer, etc. which we don’t know if its asbestos related it could have been. The lawyer says you only get money if you have some kind of birth defect but you don’t get money for the brother/sister, mother/father that you lost that was possibly from the asbestos in the mill. Do you think this case is fishy? I think its strange that they don’t know how much money him and his family are getting….
    Also the case was held in Texas and we’re in Louisiana so all the court dates or whatever were never attended by him or his family/friends only by the lawyer. So no one knows what went on in the court room. His family trusts the lawyer with everything! They think that he’s going to do everything honestly but I was trying to tell them that lawyers are crooks and you can’t trust them to handle everything for you. Next week the family is supposed to sign to close the case and he still doesn’t know how much each family will receive.       First you need to hire an attorney on your own because it is illegal in Texas for an attorney to ‘chase’ you. If indeed this was the case and there was a settlement, any fees collected by the attorney will be returned to you minus the fees for the new attorney. For example, if the case was taken on a ‘win’ basis, they usually keep 35 percent. You could hire an attorney on your own who would take the case on a wim basis and they would get 35 percent of the 35 percent. Say the original 35 percent was 100, 000 dollars, then your new attorney would get 35, 000 and you would get the rest. If it was a large settlement, this is definitely worth pursuing. If we are talking 35 percent of 10,000 dollars, you probably won’t find an attorney willing to waste his time on 3,500 dollars. Especially considering the hours involved in research and litigation.

      Then you need to go to or call the courthouse and ask to see the records, if you request a copy, you have to pay for the copy, but to view them in person it is free. You will need to know the name of the party being sued and the date (or a good estimate).

      I think that if I signed papers with an attorney, I would have been in contact with them and would know what is going on. Not sitting around on my butt waiting for it to rain money. Did they sign something? If so, read the copy. That would tell you enough info to look up the case at the courthouse.

      A lot of it seems unfair but that is the way the courts work. The only thing that is real fishy is that the lawyer doesn’t know the exact amount. To settle the case, there would have to be an exact amount to settle on. The lawyer would take his share (most times 1/3) and take out expenses and then the rest would be theirs. But he should have the exact amount. I can do the math, wonder why a lawyer can’t.

    It never stops. Should we conclude that all “scientific” studies that are widely published on lowest common denominator sites like AOL and Yahoo news are fraudulent?

      There is ALWAYS a hidden agenda. There is no such thing as an impartial study anymore. Undesirable results are simply deleted from the list of findings as unrelated to the study.

      To go along with it there is no unbiased reporting anymore. Journalism in America is yellow through and through. Every subject is picked based on what information the AP decides wants us to know and is designed to manipulate the viewer or reader to think a certain way.

      So while I wouldn’t say every study is fraudulent, I would also say if you never hear any stories with an opposing view point concerning the study, it’s safe to assume that the study is fraudulent to a certain extent.

      Uh, no, that study is not “published” to the public, it’s published in a science journal ( http://cebp.aacrjournals.org/ ) and reported on AOL. You aren’t a very good reader as the study acknowledges,

    Question for certified lawyers: Regarding access to county records?
    My family is trying to get records from our county (Sacramento, CA) regarding the demolition of my brother’s last place of residence. The reason is that the home is suspected of having “asbestos” in its walls. Both my brother and my cousin were living in that house. Since the demolition of that house my brother and my cousin have both been diagnosed with cancer.

    I contacted the housing department for our county to find out why that particular house was demolished. The operator said that home owners do not need to give a reason to request that their properties be demolished. She informed me that they are unable to release the “reason for demolition” to the public. She concluded by saying that she could not confirm or deny that there was even a “reason for demolition.”

    My question is this: If my family hires a lawyer, will he/she be able to access the past records on that house? More specifically, will they be able to find out if there was a “reason for demolition” and what that reason was?

      An attorney can petition the court for release of the records and they have no choice but to release them.~

    They took aspirin, ate blue cheese, raw egg products, loads of bacon and processed meat, tuna from a can, and didn’t get tested for diabetes or cervical cancer.
    Then after that trauma, our baby cots were covered with bright coloured lead-based paints.

    We had no childproof lids on medicine bottles, doors or cabinets and when we rode our bikes, we had no helmets or shoes, not to mention, the risks we took hitchhiking.
    As children, we would ride in cars with no seat belts or air bags.
    We drank water from the garden hose and NOT from a bottle.
    Take away food was limited to fish and chips, no pizza shops, McDonalds , KFC, Subway or Nandos.
    Even though all the shops closed at 6.00pm and didn’t open on the weekends, somehow we didn’t starve to death!
    We shared one soft drink with four friends, from one bottle and NO ONE actually died from this.
    We could collect old drink bottles and cash them in at the corner store and buy Toffees, Gobstoppers, Bubble Gum and some bangers to blow up frogs with.

    no video/dvd films,
    no mobile phones, no personal computers, no Internet or Internet chat rooms……….WE HAD FRIENDS and we went outside and found them!

    We fell out of trees, got cut, broke bones and teeth and there were no
    Lawsuits from these accidents.

    Only girls had pierced ears!

    We ate worms and mud pies made from dirt, and the worms did not live in us forever.

    You could only buy Easter Eggs and Hot Cross Buns at Easter time…

    We were given air guns and catapults for our 10th birthdays,

    We rode bikes or walked to a friend’s house and knocked on the door or rang the bell, or just yelled for them!
    Mum didn’t have to go to work to help dad make ends meet!

    RUGBY and CRICKET had tryouts and not everyone made the team. Those who didn’t had to learn to deal with disappointment. Imagine that!! Getting into the team was based on
    MERIT

    Our teachers used to hit us with canes and gym shoes and bully’s always ruled the playground at school.

    The idea of a parent bailing us out if we broke the law was unheard of.
    They actually sided with the law!

    Our parents didn’t invent stupid names for their kids like ‘Kiora’ and ‘Blade’ and ‘Ridge’ and ‘Vanilla’

    We had freedom, failure, success and responsibility, and we learned HOW TO
    DEAL WITH IT ALL !

      It doesn’t seem that long ago that we lived on another planet, where people were free to live a life and enjoy doing it. I now dread driving in “school run” time as it’s a nightmare created by the nanny state. We had two feet and used them to good effect and a bike was more of a hindrance than a help, but they came in handy at w/ends. It was then that we’d cycle miles to fish a pond that didn’t have any fish in it, but that didn’t matter as we made our own entertainment. At that time I would have made Rambo look like Mickey Mouse as we had the finest weaponry money could buy. Today you’d get six months for having these items, but we needed them. Not to stab or shoot each other but as tools to make things with, or in the case of guns and bows with real arrows a source of amusement. We made fires, not to burn things down, but to cook stuff on. No health and safety brigade needed, we had fathers who you feared more than the law as they were the law. Step over the line and the police wouldn’t arrest you give you an on the spot fine, oh no, they’d say the words that scared the life out of you “i’m going round to see your father”. Many times I thought about joining the foreign legion rather than go home, but for all our sins plus the things we ate, the trees we fell out of, we’re still alive.

      I wasn’t born in those years, but i was born in 81 – my parents raised my older sister (she was born in 78) and me pretty much the same way this email indicates… HOWEVER, my younger brother and younger sister were NOT raised the same way my older sister and i were – mom and dad bailed them out, no spankings, mom and dad made sure they got onto sports teams regardless of the try-out results, etc. etc.

      i totally agree with this – only thing i don’t agree with is the comment where mom didn’t have to work because dad could make ends meet. my grandmother worked (she was born in 1923) because she wanted to work. my mother worked because she liked to teach. i work because i like auditing (my job) – i plan to continue working after i have children, i just won’t work full-time. what kills me is when my mom says she didn’t work when i was younger – but she did!! she says she can’t believe i’ll let other people raise my children (aka putting them in daycare – God forbid!!). I see nothing wrong with daycare and i don’t consider it “other people raising my children.”

    A trip to the beach on a warm day was always a special treat.

    We drank water from the stream and NOT from a bottle.

    Take away food was limited to fish and chips, no pizza shops, McDonalds, KFC, Subway or Kebabs.

    Even though all the shops closed at 6.00pm and only opened for a few hours at weekends, somehow we didn’t starve to death!

    We shared one soft drink with four friends, from one bottle and NO ONE actually died from this.

    We could collect old drink bottles and cash them in at the corner shop and buy fruit Spangles and some bangers to blow up frogs with.

    We ate buns, white bread and real butter and drank soft drinks with sugar in it, but we weren’t overweight because……

    We would spend hours building our trolleys out of scraps and then ride down the hill, only to find out we forgot the brakes. We built tree houses and dens and played in streams with matchbox cars.

    We did not have Playstations, Nintendo’s, X-boxes, no video games at all, no 99 channels on Sky, no video tape or DVD movies, no surround sound, no personal computers, no Internet or Internet chat rooms……….WE HAD FRIENDS and we went outside and found them!

    We fell out of trees, got cut, broke bones and teeth and there were no
    Lawsuits from these accidents.

    Only girls had pierced ears!

    We ate worms and mud pies made from dirt, and the worms did not live in us forever.

    You could only buy Easter Eggs and Hot Cross buns at Easter time…….no really!

    We had air guns and catapults for our birthdays,

    We drank milk laced with Strontium 90 from cows that had eaten grass covered in nuclear fallout from the atomic testing.

    We rode bikes or walked to a friend’s house and knocked on the door or rang the bell, or just yelled for them from the street!

    Mum didn’t have to go to work to help dad make ends meet!

    Mum & dad didn’t need Brandy, Whisky whatever when they came in from work!

    Footy had tryouts and not everyone made the team. Those who didn’t had to learn to deal with disappointment. Imagine that!!

    Our teachers used to belt us with big sticks and leather straps and bully’s always ruled the playground at school.

    The idea of a parent bailing us out if we broke the law was unheard of. They actually sided with the law!

    This generation has produced some of the best risk-takers, problem solvers and inventors ever!

    The past 70 years have been an explosion of innovation and new ideas.

    We had freedom, failure, success and responsibility, and we learned

    HOW TO
    DEAL WITH IT ALL!
